Continue to APPLY!This position will be part time, we are looking for someone who would be available for 2 -3 times a day, or a half day position.
The duties would entail:
Contracts and tenders:
Draft new requested contracts;
Review supplier and vendor contracts to ensure FCTG is legally protected;
Negotiate legal terms with the other contracting party's legal department if necessary;
Review tenders' terms and conditions prior to submission and assist BDM's with markups / a markup document to submit with the tender;
Ensure NDA's are signed for necessary disclosures and retain copies thereof;
Review and comment on amendments to our standard terms/contracts;
Advise senior managers on legal disputes relating to contracts.
Review all company terms and conditions, supplier contracts, credit applications, NDA's etc. annually.
2. Litigation:
Advise the company/stakeholders on all legal matters.
Take ownership of all litigation or legal matters.
Respond to attorneys' correspondence.
Administer and manage pending matters with external attorneys.
Give instruction to external attorneys.
3. IR:
Chair disciplinary hearings and ensure that the outcome and penalty are sent timeously.
Manage and oversee restructures and ensure that we are compliant with the LRA.
Ensure our policies are up to date and compliant with legislation and amendments to the law.
4. Ad hoc legal duties:
Small Claims Court: respond to summons' and appear in court (this is from 17:00 onwards).
Consumer Council: support Kim Taylor in drafting responses and appear at Consumer Court.
CCMA: represent the company at conciliation and arbitration - draft all necessary documents.
Advertising Standards Authority: respond to complaints lodged with the ASA and represent the company at any hearings.
Criminal matters: assist Internal Audit Leader with any investigation and ensure criminal cases are opened. Liaise with the prosecution to ensure we successfully prosecute the offenders.
Deal with ad hoc legal matters ie. customers, employees, restraint of trade matters.
5. Leases:
Review certain leases.
Advice leasing manager on all lease disputes / early terminations.
6. Debt collection:
Send final letters of demand.
Correspond with debtors regarding repayment agreements (draft, obtain signatures and ensure payment is effected timeously).
Debt Collectors: hand relevant matters over to debt collectors and manage this process.
